These Terms and Conditions govern access to lamyssjewels.com and the sale of products offered through the Website.

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions.

Hereinafter referred to as the “Seller” or “Lamyss Jewels”.

2. Products

Lamyss Jewels sells jewellery designed by the brand and handcrafted in Italy.

The main characteristics of each product, including materials, dimensions and available variants, are described on the relevant product page.

Due to the handcrafted nature of the production process, slight variations may occur between individual pieces. Where these variations do not affect the quality, functionality or conformity of the product, they are considered a characteristic of handcrafted production rather than a defect.

Product photographs and images are prepared with the greatest possible care. However, colours, reflections and proportions may appear slightly different depending on the customer's screen and display settings.

3. Product Availability and Orders

Products may be purchased through the Website by following the checkout procedure.

Submitting an order constitutes an offer to purchase by the customer.

The sales contract is considered concluded when the customer receives an order confirmation at the email address provided during checkout.

Lamyss Jewels reserves the right not to accept an order before confirmation in the event of:

• incomplete or clearly incorrect shipping information;

• product unavailability;

• inability to process payment;

• reasonable suspicion of fraud or unlawful use of payment systems;

• inability to deliver to the selected country or address.

If, exceptionally, a product becomes unavailable after the order has been confirmed, the customer will be informed promptly and any amounts already paid will be refunded.

4. Prices

All prices are expressed in Euro (€) and represent the final selling price of the products, excluding shipping costs and any other additional charges clearly disclosed before the order is placed.

The Seller currently operates under the Italian flat-rate tax regime (“regime forfettario”) pursuant to Italian Law No. 190/2014, as amended.

The tax treatment applicable to individual transactions, including any cross-border sales, is determined in accordance with the tax legislation in force.

Prices may be changed at any time. Any changes will not affect orders that have already been concluded, which will be charged at the price displayed at the time of purchase.

5. Payment Methods

Available payment methods may include:

• credit or debit card;

• PayPal;

• bank transfer;

• cash on delivery.

The payment methods actually available for each order are displayed at checkout.

For bank transfer payments, the order will be processed after the payment has been credited to the Seller's account. The necessary bank transfer instructions will be provided during or following the order process.

For cash on delivery, payment is made upon delivery in accordance with the procedures provided by the carrier. Cash on delivery may not be available for all countries, addresses or shipping methods. Any additional charge will always be clearly shown before the order is placed.

For orders paid by cash on delivery, any refund may be made by bank transfer, subject to agreement with the customer and at no additional cost to the customer.

Electronic payment information is handled by the relevant payment service providers in accordance with their own terms and security policies.

6. Shipping and Delivery

Lamyss Jewels ships to the countries available at checkout. Shipping is currently available to Italy and France.

Shipping costs are displayed before the order is placed and may vary depending on the destination country, delivery method selected and any promotions currently available.

Estimated preparation and delivery times are displayed on the Website, on the Shipping page or during checkout.

Unless otherwise stated, delivery normally takes approximately 5-10 business days from the date the order is handed over to the carrier. Any different preparation times will be stated on the relevant product page or communicated to the customer.

Where no different delivery time has been agreed, delivery will in any event take place within the time limits provided by applicable law.

Delivery times are estimates and may vary due to circumstances outside the Seller's reasonable control.

Once the parcel has been handed over to the carrier, the customer will receive tracking information where such tracking is available.

The Seller remains responsible for the goods until the customer, or a third party designated by the customer other than the carrier, physically receives them, unless the customer independently appoints a carrier that was not offered by the Seller.

The customer is responsible for providing a complete and accurate delivery address.

7. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 calendar days from the date on which they receive the goods, without providing any reason.

To exercise the right of withdrawal, the customer must communicate their decision clearly within the applicable period by contacting:

The customer may use the model withdrawal form provided at the end of these Terms and Conditions, but use of the form is not mandatory.

After notifying Lamyss Jewels of the withdrawal, the customer must return the goods without undue delay and in any event within 14 days from the date on which the withdrawal was communicated.

The direct cost of returning the goods is borne by the customer, unless the goods are defective or non-conforming or Lamyss Jewels has agreed otherwise.

The product should be returned with all items and accessories originally supplied and, where reasonably possible, in its original packaging.

The absence of the original packaging does not automatically result in the loss of the right of withdrawal.

The customer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the circumstances provided by applicable law, including in particular goods that are:

• made to the consumer's specifications;

• clearly personalised for the consumer.

The fact that a product is prepared or manufactured after an order has been received does not in itself remove the right of withdrawal where the item is a standard, non-personalised product from the catalogue.

9. Refunds Following Withdrawal

Where the right of withdrawal has been validly exercised, Lamyss Jewels will refund the amounts due within 14 days from the date on which it is informed of the customer's decision to withdraw.

The Seller may withhold the refund until the returned goods have been received or until the customer provides evidence that the goods have been sent back, whichever occurs first.

Where the customer withdraws from the entire order, the refund will also include the cost of the least expensive standard delivery method offered for that order.

Any additional costs resulting from the customer's choice of a more expensive delivery method than the standard delivery offered will not be refunded.

Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed with the customer and provided that the customer does not incur any additional fees.

For orders paid by bank transfer, refunds may be made by bank transfer. For orders paid by cash on delivery, a bank transfer refund may be agreed with the customer.

10. Defective Products and Legal Guarantee of Conformity

All products sold to consumers are covered by a minimum 2-year legal guarantee of conformity from the date of delivery, in accordance with applicable Italian and European consumer law, without prejudice to any additional mandatory rights available to the consumer under applicable national law.

A product is considered conforming when, among other things, it corresponds to the description provided, has the qualities and characteristics promised and is fit for the purposes normally expected of goods of the same type.

Where possible, photographs may be helpful in assessing the issue. Providing photographs does not, however, affect the customer's statutory legal guarantee rights.

Where a lack of conformity exists, the consumer is entitled to the remedies provided by applicable law, which may include free repair or replacement and, where the legal requirements are met, a price reduction or termination of the contract with a refund.

Any costs necessary to bring a genuinely defective product into conformity, including any necessary shipping costs, will not be borne by the consumer.

The legal guarantee does not cover damage caused by misuse, accidents, unauthorised modifications or repairs, failure to follow product care instructions or normal wear and tear, provided that such circumstances are actually responsible for the issue.

11. Liability and Force Majeure

Lamyss Jewels undertakes to process and fulfil orders with reasonable care.

The Seller cannot be held responsible for delays caused by exceptional events outside its reasonable control, including, by way of example, natural disasters, serious transport disruptions, widespread strikes, government measures or other events of force majeure.

Nothing in this section limits or excludes any mandatory rights granted to consumers under applicable law, including rights relating to delivery, the legal guarantee and refunds.

12. Intellectual Property

The Lamyss Jewels brand, logo, texts, photographs, images, graphics, editorial content, product designs and other content appearing on the Website are protected by applicable intellectual and industrial property laws where the relevant legal requirements are met.

Such content may not be copied, reproduced, distributed, modified, commercially exploited or published without the prior permission of the relevant rights holder.

13. Use of the Website

Customers agree to use the Website lawfully and to provide accurate and truthful information when placing an order.

Lamyss Jewels is not responsible for the content or services of third-party websites that may be accessed through links appearing on the Website.

14. Privacy and Personal Data

Personal data is processed in accordance with applicable data protection legislation.

15. Complaints and Dispute Resolution

Lamyss Jewels will seek to handle complaints and find a solution within a reasonably prompt timeframe.

For cross-border disputes within the European Union, consumers may also seek assistance from the European Consumer Centres Network (ECC-Net) and from any applicable Alternative Dispute Resolution mechanisms.

The use of an alternative dispute resolution procedure does not affect the consumer's right to bring proceedings before the competent courts.

16. Applicable Law and Jurisdiction

These Terms and Conditions and sales contracts concluded through the Website are governed by Italian law.

However, this choice of law does not deprive consumers of any mandatory protection granted by the law of the country in which they habitually reside where such provisions apply to the contract.

Any dispute involving a consumer will be subject to the jurisdiction of the courts determined in accordance with the applicable consumer protection rules.

17. Changes to These Terms and Conditions

Lamyss Jewels may update these Terms and Conditions at any time for legal, commercial or organisational reasons.

Each order will be governed by the version of the Terms and Conditions in force at the time the order is placed.

Changes will not apply retroactively to orders that have already been concluded.
